Human Resource Management Essay Example | Topics and Well Written Essays - 2250 words - 4
Human Resource Management - Essay Example This gave rise to a dispute during which Mr Nikolich alleged that he was intimidated and threatened by his supervisor, which caused him stress. Furthermore, the Companyââ¬â¢s HR Manager took a long period of four months to investigate the complaint and determined that the reallocation was quite appropriate and that the supervisorââ¬â¢s conduct had not been intimidating or threatening and had also stepped down from his managerial role. There was no further action taken on Mr. Nikolichââ¬â¢s complaint, as a result of which he developed a depressive disorder and was terminated from his work. The basis of Mr. Nikolichââ¬â¢s complaint of mistreatment by his supervisor and the mishandling of his complaint was the terms of his letter of offer of employment and policy guidelines of the Company, entitled Working With Us. This guideline contained several provisions on workplace health, safety, harassment and grievance redressal procedures which Mr. Nikolich alleged had been breached in his case as a result of which the employers were guilty of a breach of contract. At the lower Court, the findings were in favor of the Plaintiff, Mr. Nikolich and the Court held that sections of the Working With Us policy guidelines were equivalent to explicit promises which were part and parcel of Mr. Nikolichââ¬â¢s employment contract.. On this basis, the Court held that the failure of the HR management to take immediate action to resolve the conflict between Mr. Nikolich and his supervisor was a breach of contract. When the case was appealed however, the appellate judges make a distinction between contractual and aspirational terms. They held that the policies outlined in the Working With us document on the issues of harassment and grievance redressal were not in the nature of contractual terms. On the contrary, they were aspirational in nature, i.e, the language contained in tees provisions was descriptive and informative, intended to be encouraging rather than iron clad promises.

Nursing Education Around the Globe - Research Paper Example ya The major comparison in the government influence of the nursing education between China and Kenya is that; both countriesââ¬â¢ initiative to establish nursing training and certification were started by the respective governments, with the Kenyan training and certification program running for 31/2 years, while the Chinese program took 4 years (Xu, Xu & Zhang, 2000). Political control has also characterized the nursing profession and development in both Kenya and China, where the respective governments, through the ministries of health, have been responsible for approving the nursing courses and certification programs in the countries (Klopper & Uys, 2003). The governments have been involved in establishing regulations and laws that governs and controls the nursing profession. Several laws and ordinances have been established by the two governments, to act as the tools through which the nursing profession is politically controlled. In Kenya, the 1946 June Ordinance No. 16 was est ablished to control the health activities of the nurses (Mule, 1986). Similarly, the political control of nursing profession in China can be traced back to 1949, when the education reform in China abolished the post-secondary nursing training, instead introducing the 3-year nursing training, following the 9 years of primary and secondary education (Xu, Xu & Zhang, 2000). Both countries have established Nursing organizations, responsible for uniting, developing, and promoting nursing professionalism, with the Nursing Council of Kenya (NCK) being the peak body of the nursing profession in the country, while the Chinese Nursing Association (CAN), is similarly the peak nursing organization in China (Xu, Xu & Zhang, 2000). The Level of Audit fees - current issue in Auditing with special Essay
The Level of Audit fees - current issue in Auditing with special emphasis to FTSE 100 Companies in UK - Essay Example In UK, the ââ¬Å"Big Four audit firms namely Ernst & Young , Deloitte & Touche, PricewaterhouseCoopers (PwC) and KPMG are acting as auditors for almost all the FTSE 100 companies and has major lion share of audit fees of about 99% in the FTSE 350. The reason why FTSE companies prefer the Big Four as it offers two major service elements namely high profile audit services together with the insurance coverage against reputational risk and catastrophes. It is to be noted that in UK, the top ten accounting firms are earning an income of above ? 1.5 billion annually as audit fees. (Oxera 2006: i). As per Francis (2006), there is direct correlation between share prices of US companies and the level of non-audit service fees paid to auditors as the shares of those companies, which pay higher NAS (Non Audit Services) have been observed to be poignantly lower. As per Basioudis et al. (2008) research study which was conducted among UK companies in 2003 found that high NAS fees and exorbitant a udit fees badly affect going companies revealing analysis for financially impacted companies in UK. Through UK market data study of 1999-2006, Holland and Lane (2009) found that shareholders are of the opinion that auditorââ¬â¢s independence will be at stake due to high level of both audit and NAS fees. (Beattie, Fearnley and Hines 2009:6). A research study carried over by POB over the NAS fees charged by the Big Four audit forms for the period between 2003 and 2008 reveal that there had been a steep fall in NAS fees from their clients as it came to just 17% in 2008 from that of 25% in 2003. However, the fee income earned for non-audit customers increased to 59% of total income in 2008 from that of 49% of total income in 2003. (Beattie, Fearnley and Hines 2009:7). Deloitte (2009) research... According to the research findings in UK, the level of audit fees is seemed to be higher as there is a high market concentration, especially in the FTSE 100 sector. Through UK market data study of 1999-2006, Holland and Lane found that shareholders are of the opinion that auditorââ¬â¢s independence will be at stake due to high level of both audit and NAS fees. However, the research study carried out by Srinidhi & Gul, Abbott et al. and Carcello et al., the quality of audit is gauged by the quantum of audit fees paid to an auditor of a company. Higher audit engagement effort is reflected by high levels of audit fees and would always result in better audit quality. In case of risk prone companies, the auditor has to incur insurance cost which in turn result in an increase in the audit fees. Further, the level of audit fees might have increased substantially due to changes in the general economic scenarios and due to change in regulations and rules pertaining to audit. Further, the a uditor independence will be at jeopardy if he has been awarded with substantial non-audit work also like consultancy services, accounting services, internal audit, corporate transactions, internal audit, regulatory compliances, merger and acquisitions, advise on restructuring and advise on taxation. It is to be noted that higher audit fees always result in supporting the corporate frauds.Researchers have pointed out that Arthur Andersen have received $27 million for their audit services in addition to $29 million for non-audit services from Enron in 2000.

CASE STUDY Essay Example | Topics and Well Written Essays - 500 words
CASE STUDY - Essay Example Typically, a client that is very serious about purchasing a new product, a new line, or a development package is usually going to be on time to the meeting and show the salesperson as much respect as possible in hopes that they can ease down the price of the products with their charm and good will. At 10:20am another non-verbal clue took place when another salesperson that was Andrewsââ¬â¢ competitor walked into the office for a 10:30am appointment. Not only was the buyer for Skaggs Manufacturing tardy for their meeting, but she already had another salesperson scheduled for an immediate meeting right after Andrews. Gillespie also showed many counts of blatant disrespect toward Andrews. For one, there was a 10 minute period where she was discussing a tennis match for that day with the secretary instead of concentrating on who was there for a scheduled appointment. Finally, as Andrews began to speak with Gillespie in her office she gave him no attention, no eye contact and was focused on reading letters from her desk instead of what he had to say. The final sign of disrespect came when she answered the phone in the middle of their meeting and began talking with her husband for another 10 minutes until she finally saw the frustration on Andrewsââ¬â¢ face. Each of these non- verbal clues was blatant hints that Andrews was not going to be able to earn the business of Skaggs Manufacturing that morning and he had definitely wasted his time. If I was John Andrews, I would have likely performed many of the same behaviors that he did. He kept calm during many different frustrating events where he was being blatantly ignored and disrespected by the buyer for Skaggs Manufacturing. Still, his job is to sell the product, so it is important to maintain an aura of professionalism and do his best to earn the customerââ¬â¢s business. Unfortunately, he was never able to actually give a sales pitch

Personal development plan Statement Example | Topics and Well Written Essays - 750 words
Development plan - Personal Statement Example Having been into Loughborough expanded my interests and knowledge better. I came to realize that Business Management requires me to be well-rounded. Having numerical skills is an advantage, but there are other traits required of me such as a good market sense, excellent inter personal skills, people skills and management. Along the way, I felt the drive to improve in each area. Most of my subjects became the driving force for me to be always one step ahead of my curriculum. I also took pains in improving my communication skills and became involved in activities that helped me become a good speaker and enabled me to improve my public relations skills. My one year internship in PricewaterhouseCoopers, Hong Kong, gave me the opportunity to put my skills and knowledge into practice, as I became involved in customer management while I assisted in providing accounting and business advice to clients. Being in the workplace challenged me not to make mistakes. Accuracy is one of the goals I h ad to achieve, being in a situation that allowed me to influence the clientsââ¬â¢ business decisions. For one year, I was able to see Business Management on a personal note, seeing firsthand the challenges that businessmen face. Figures, when transformed into useful data, can make or break a business. From then, I had a much clearer vision of what I want to do after pursuing my bachelorââ¬â¢s degree in Business Management. I see myself employed in a Multi National company, rising from the ranks in the span of ten years, most probably specializing in Marketing and Financial Management. My short-term goal includes immediately getting into a post graduate degree in Business Management after my graduation. Pursuing higher studies will translate into obtaining better qualifications so I can land a good job in any of my dream companies. A Masters Degree will also enhance my skills, provide me more opportunities to hone academic skills and hopefully, apply them in a real business set ting. I plan to do this by getting an entry level job in the middle of pursuing my Masters Degree. I firmly believe that one can only fully understand the concepts learned in school by putting them into practical use. Having a real job will allow me to do this. To succeed in post graduate school will prove to be a challenging feat to me, but I see no reason why I would fail. Academically speaking, I have sufficient knowledge and experience for me to understand the ropes of this course. My quantitative skills and immense interest in Business will definitely get me across my goals. I also recognize my personal skills that would help me get through graduate school. I am a results oriented person who always has a set of goals, short term and long term, to accomplish. I set my own pace basing on the goals that I have set. I am motivated, self driven, who always strive for excellence in the things I do. I am highly inquisitive, always wanting to go deeper into my interests. Moreover, I co nsider myself to have above average leadership skills. I have the ability to encourage a group of people towards achieving goals. Further to this, I have special interest in the culture and the arts, which was brought forth by the fact that I have travelled in various countries and immersed into difference cultures. I can adapt well in any
